Whether you’re a policyholder, NRI, or a victim of corporate malpractice, knowing how to legally file an insurance fraud complaint is crucial to securing your rights and refund.

Here’s a step-by-step guide to help you take action the right way:

Step 1: Collect Evidence

Start by gathering all relevant documentation:

  • Policy bond/certificate
  • Premium receipts or transaction proofs
  • Screenshots of WhatsApp/chat/email communication
  • Agent details, voice recordings (if any)
  • Fake loan promises or verification call transcripts

The more organized your documentation, the stronger your complaint.

Step 2: File an Online Complaint on IRDAI’s IGMS Portal

Visit: https://igms.irda.gov.in

Create an account and log your complaint under the name of the insurer. Mention clearly:

  • Nature of fraud (e.g., mis-selling, no consent, fake verification call)
  • Policy number and insurer name
  • Relief sought: Cancellation + Refund

IRDAI forwards this to the concerned insurance company, which must respond within 15 days.

Step 3: Call the 1930 Helpline (If Linked to Cyber Fraud)

If the fraud involved forged links, e-KYC misuse, or UPI fraud, immediately:

Request that the fraud account be frozen and tracked for recovery.

Step 4: File a Written Complaint with the Insurer

Email and post a formal written complaint to the insurance company:

  • Mention all policy details and the nature of mis-selling or fraud
  • Attach documents
  • Ask for action under IRDAI (Protection of Policyholders’ Interests) Regulations, 2017

Mark a copy to complaints@irdai.gov.in and the insurer’s grievance redressal head.

Step 5: Send a Legal Notice

If no action is taken within 15-20 days:

  • Send a legal notice through a qualified advocate
  • Cite relevant laws: Consumer Protection Act, BNS 2023 Sections 316 (cheating), 336 (forgery), 342 (electronic record), etc.
  • Demand refund and policy cancellation

Step 6: File Police FIR or Consumer Complaint

Still unresolved? You may now:

  • File an FIR at the local police station or cyber crime unit
  • OR file a complaint with the District Consumer Forum for refund and compensation

Attach all records, including the IRDAI complaint number and legal notice.
